Declaration and commitment of the participant (Minors)

Assumption of Risks

I hereby declare that I am duly authorized to act for and on behalf of the Minor, so that he/she may take part in one of several of the activities sanctioned by Les Entreprises Scajja inc. et/ou Karting Orford inc. according to the terms and conditions of this document.

I am aware of the nature of the activity which is being proposed by Les Entreprises Scajja Inc. et/ou Karting Orford, which involves the use of a motor vehicle in dangerous conditions.

I am aware of the nature of the activity or activities which are being proposed as well as the experience of the Minor and I am convinced that he/she has the competence and skill to participate therein.

I acknowledge and accept that the trails and layouts that the Minor will be using cannot be the object of meaningful surveillance and that, moreoever, their condition may deteriorate during the activity and they may become hazardous.

I acknowledge and accept that numerous obstacles such as rocks, trees, cracks, etc. may be found on the trails and layouts.

I acknowledge and accept that the configuration of said trails and layouts as well as the very nature of the activity and the manoeuvres of the participants create considerable dangers and risks.

I therefore acknowledge and accept that in taking part in said events; the Minor exposes himself/herself to risks of serious injuries or even death.

I hereby declare having properly informed the Minor of all the risks indicated hereinabove and of any other risk which I may be aware of. In the event I deem that said risks are too high for him/her, I will put him/her out of the activity.

I declare that I am fully aware of those serious risks and dangers and I agree, notwithstanding said knowledge, to allow the Minor to have access to the site and/or participate in any of the events sanctioned by Les Entreprises Scajja inc. et/ou Karting Orford inc.

Waiver of Recourse for Property Damage

For and on behalf of the Minor, I hereby waive any recourse for property damage that the Minor may sustain during his/her presence on the site or his/her participation in one or several of the vents of Les Entreprises Scajja inc. et/ou Karting Orford Inc., regardless of whether said property damages are caused by an accident, through the fault or negligence of a third party or the Club. The present waiver inures to the benefit of Les Entreprises Scajja Inc. et/ou Karting Orford Inc. its directors, employees, members, successors and assigns, as well as the promoters, participants, track operators, track owners, officials, rescue personnel, sponsors, announcers, or any other person or organization having participated in the production of the activity, its setting up or its promotion.

Should the Minor institute recourses against the aforementioned beneficiaries notwithstanding this waiver, I will hold the latter harmless from any condemnation which may be pronounced against them in capital, interest and costs, and I will reimburse the attorney’s fees required to ensure their defence of said recourse.
